This agreement is a legal contract and conforms to the California State Truth in Renting Act and the Landlord Tenant Statute. It is designed to insure good communications for all parties. It recognizes that prospective renters often evaluate many properties in their quest for a vacation rental property and at the time a commitment is made to the owner, there could be confusion about the owner’s terms and desires. It also provides the renter with a conformation of their reservation.
THIS AGREEMENT, entered into this ____ day of ________________ 2002, by and between Mark Daniels, hereinafter the owner and __________________________________ hereinafter the renter.
WITNESSETH: In consideration of the payment for rent and the performance of the covenants contained on the part of the renter, the owner does let unto the renter and the renter rents from the owner those premises described as Rental Unit #_____.

CANCELLATION. All refunds are subject to a $25.00US cancellation fee. If a cancellation occurs during the time the owner has received the deposit, but prior to receiving the rental payment, the deposit will be forfeited, unless a new booking is secured and a successful rental is obtained. If a cancellation occurs after the owner has received the deposit and the rental payment, the entire rental amount is forfeited, unless a new booking is secured and a successful rental is obtained; however, the deposit will be refunded regardless.
OCCUPANTS. Said rental unit will be occupied by no more than the unit is listed to sleep.
PETS. There are no pets allowed on the property.
CHECK-IN. Check-in will be after 3pm. Key pickup must be prearranged with Friday's California Beach Rentals.
CHECK-OUT. Check-out will be prior to 11am. Keys must be left in the unit. Unit must be locked. Late checkout must be prearranged.
SMOKING. There will be no smoking anywhere in the rental unit.
AMENITIES. The said premises contains amenities as described on the web page http://www.fridaysbeachrentals.com, with the possible exception of unforeseen required maintenance of said items.
MAINTENANCE & REPAIRS. Any items in need of maintenance or repair, not already discussed with the owner, will be brought to the attention of the owner immediately. No action will be taken by the renter without first discussing it with the owner.
ERROR/OMISSION. Mr. Friday's California Beach Rentals will exercise care in avoiding conflicts with reservations; however, if through error/omission, the rental unit is occupied or otherwise unavailable for any reason on the dates of this rental agreement, and if substituted accommodations of a similar quality and price range are available when the error is discovered, Mr. Friday's California Beach Rentals reserves the right to provide such accommodations at a rat within the price range of this agreement. Such arrangements may be accepted, or cancellation of this agreement will result in refund of deposit as liquidation damages, In no event will the renter be permitted to demand the removal of those occupying the rental unit.
CLAIMS. You agree to indemnify and hold harmless Mr. Friday's California Beach Rentals, their agents, and employees from any claim or demand arising from any use of the rental unit.

In consideration of the rental of Unit #____ by its owner (Mark Daniels) to you, as his guests (_____________), it is agreed that:
1. The guests have read and will follow the rules of this Agreement.
2. When the Guests vacate the rental property at the end of the rental term, they will leave the property in the same condition it was upon arrival. If, upon arrival, the Guests should notice any conditions that cause them concern, please inform the staff. The Guests, jointly and severally, are responsible for damage to the Home caused by their misuse.
3. The Owner cannot accept any responsibility or liability for costs or damages caused by personal injury, death, accident, lost, stolen or damaged property, loss of mental or physical enjoyment, delay or inconvenience. Accordingly, the Guests covenant and agree the Owner is not responsible for damages such as motorcycles (ATC), surfboards, bikes, falls from pool decks or sliding glass door injuries.
For the execution interpretation and enforcement of this Agreement, the parties expressly submit to the laws in effect and to the courts of San Luis Obispo, California, hearby waiving any other jurisdiction that may now or hereafter be applicable by reason of their present or future domiciles.
Waiver of Liability: Mark Daniels and his staff, shall not be liable to the guests for any claims, losses, damages, costs of expenses in connection with; 1) any delays or changes in schedule, itineraries, 2) the act or ommissions of any party, 3) monetary crisis, labor problems, economic changes, mechanical maintenance or construction difficulties, climatic aberrations, local laws, novel or unexpected conditions; 4) absence of travel documents, passports, visa and health certificates, where required.
Each adult guest who intends to occupy the home has read and understands this agreement. Other than the adults signing below, no other persons, except minors accompanying the adults, will be guests at the home. Agreement to the above terms is also agreement, as guardian, on behalf of guests who are minors. If any guest does not sign this agreement, or if any guest is unable to sign as a guardian of a minor, the signing guests will indemnify and save harmless the owner from any resulting liability incurred and be responsible for any damage to the home.
Confirmations are obtained upon the receipt this agreement and a deposit of 50% of the property rental. The balance of 50% must be paid in advance, not later than 10 days prior to occupation of the rental. The deposit is not refundable unless the confirmed period can be filled.
The Guests shall pay a security deposit of $500.00 to cover expenditures, breakages or damages to property. Deposit is required with delivery of this agreement and will be refunded within 30 days after occupancy less the cost of any such occurrence.
